On 13 March 2024, the EBA published its final report on draft RTS on complaints handling for issuers of asset referenced tokens (ARTs) under MiCAR. The document sets out the requirements, templates and procedures for handling complaints received by issuers of ARTs. The draft RTS contain requirements related to the complaints management policy and function, the provision of information to holders of ARTs and other interested parties, templates, recordings, languages, the procedure to investigate complaints and to communicate the outcome of the investigations to complainants, as well as provisions for complaints handling involving third-party entities. The draft RTS had previously been subject to a public consultation between 12 July 2023 and 12 October 2023. The draft RTS will now be submitted to the European Commission for endorsement by 30 June 2024 and will afterwards be subject to scrutiny by the European Parliament and the Council before being published in the EU Official Journal.
