
On the 6th of October 2025, the three European Supervisory Authorities (the European Banking Authority, the European Insurance and Occupational Pensions Authority, and the European Securities and Markets Authority – the ESAs) issued a warning to consumers about potential risks related to crypto-assets and potential limits to legal protection depending on the types of crypto-assets and crypto-asset services they are using. The warning is accompanied by a factsheet, which gives an overview of what crypto-assets are, which ones are (not) regulated under Regulation 2023/1114/EU (MiCAR), and the providers consumers may come across. The ESAs recommend consumers to learn about the product or service and assess the risk before investing, check the crypto-asset service provider is authorised in the EU, and ensure any wallets to store their crypto-assets are sufficiently secured.
