On 30 May 2024, the European Commission Delegated Regulation 2024/1504/EU supplementing MiCAR was published in the Official Journal of the European Union. It specifies the procedural rules for the exercise of the European Banking Authority (EBA)’s power to impose fines and periodic penalty payments on issuers of significant ARTs and significant EMTs. The EBA can impose such fines and periodic penalty payments if it finds the issuer under investigation to have committed one of the infringements listed in Annexes V (for significant ARTs) or VI (for significant EMTs) to MiCAR. The Delegated Regulation was adopted on 22 February 2024 and will enter into force on 19 June 2024.
