
On 10 December 2024, the three European Supervisory Authorities (the European Banking Authority, the European Insurance and Occupational Pensions Authority and the European Securities and Markets Authority – the ESAs) published Joint Guidelines aimed to facilitate consistency in the regulatory classification of crypto-assets under Article 97(1) of Regulation 2023/1114/EU (MiCAR). The Guidelines outline a standardised test to promote a common approach to classification, and include templates for market participants to provide supervisors with the regulatory classification of crypto-assets in the cases of asset-referenced tokens (ARTs) and crypto-assets which are neither ARTs nor e-money tokens (EMTs) under MiCAR.
The Guidelines will be translated into the official EU languages, published on the ESAs’ websites, and will apply from three months after the publication of the translations.
