EBA publication of its consultation paper with a draft methodology to set fines under MiCAR, 26 June 2026

On the 26^th of June 2026, the European Banking Authority published a consultation paper with a draft methodology to set fines in its role as supervisor under the Markets in Crypto-Assets Regulation (2023/1114/EU, MiCAR). The consultation outlines the EBA’s proposed approach to calculate fines where an issuer of significant tokens, or a member of its management body, has negligently or intentionally committed an infringement.

Interested stakeholders can submit their comments to the consultation paper at the following link by the 28^th of September 2026. The EBA will hold a virtual public hearing on the 16^th of July 2026 from 14:30 CEST.
